What is Aqd Ajeer عقد أجير?

Aqd Ajeer (عقد أجير) is a temporary work contract system in Saudi Arabia regulated by the Ministry of Human Resources and Social Development (MHRSD – وزارة الموارد البشرية والتنمية الاجتماعية).
It allows one company to send its worker to another for a limited time without transferring the Iqama (الإقامة).

Simply:
Aqd Ajeer (عقد أجير) = Temporary work contract between two companies.


Example: Company A & Company B

  • Company A (Sponsor / الشركة الراعية): Al-Faisal Trading
  • Company B (Borrower / الشركة المستعيرة): Red Crescent Events
  • Worker / العامل: Mohammad Khan (Iqama No. 2345678901)

Scenario:
Company B needs event technicians for 3 months. Company A has available workers. Both companies create an Aqd Ajeer (عقد أجير) contract → Worker Mohammad Khan works under Company B temporarily, but his Iqama remains under Company A.


Step by Step Process to Create Aqd Ajeer Contract

  1. Login / تسجيل الدخول → Company A logs into its Ajeer portal.
  2. Select Service / اختيار الخدمة → Navigate to Contracts العقودIssue Contract / إصدار العقدService of contracting between establishments / خدمة التعاقد بين المنشآت.
  3. Enter Borrower Details / إدخال بيانات المنشأة المستعيرة → Company A enters Company B’s Establishment ID Numbe رقم المنشأة.
  4. Select Worker / اختيار العامل → Worker is selected from Company A’s employee list (Mohammad Khan).
  5. Draft Contract / إعداد العقد
    • Start Date / تاريخ البداية: 20-Sep-2025
    • End Date / تاريخ الانتهاء: 19-Dec-2025 (3 months)
    • Job Title / المسمى الوظيفي: Event Technician
    • Salary / الراتب: 4,000 SAR/month
    • Insurance Responsibility / مسؤولية التأمين: Company A
    • Payment Responsibility / مسؤولية الدفع: Company B
  6. Approvals / الموافقات
    • Company B approves the contract / الشركة المستعيرة توافق على العقد
    • Worker approves via Qiwa account / العامل يوافق على العقد من خلال حساب قيــوة
  7. Payment / الدفع → Company B pays the Ajeer/Qiwa fees / رسوم أجير/قيــوة via SADAD / سداد.
  8. Activation / تفعيل العقد → Contract becomes active; the worker legally works for Company B.
  9. Completion/Extension / انتهاء العقد أو تمديده → At the end of 3 months, the worker returns to Company A. Extension requires a new contract.

Terms & Conditions / الشروط والأحكام

  1. Worker remains under the original sponsor / العامل يبقى تحت رعاية الشركة الراعية.
  2. Worker performs only the tasks specified / يقتصر العمل على المهام المحددة في العقد.
  3. Salary responsibility / مسؤولية الراتب: Company B
  4. Insurance & GOSI / التأمين و التأمينات الاجتماعية: Company A
  5. Working hours & leaves / ساعات العمل والإجازات: Saudi Labor Law
  6. Contract completion / انتهاء العقد → Worker returns automatically
  7. Early termination / إنهاء مبكر → Through portal
  8. Illegal work / الأعمال غير القانونية → Both companies liable
  9. Portal fees / رسوم البوابة → Always Company B
  10. Disputes / المنازعات → MHRSD or Labor Court

Requirements / المتطلبات

Company A (Sponsor / الشركة الراعية)

  • Valid Commercial Registration (CR / السجل التجاري)
  • Active Qiwa قوي subscription
  • Worker’s valid Iqama + Insurance / الإقامة والتأمين
  • Active GOSI / التأمينات الاجتماعية

Company B (Borrower / الشركة المستعيرة)

  • Valid CR
  • Qiwa / قوي portal access
  • SADAD / سداد account for payment

Worker / العامل

  • Valid Iqama / إقامة سارية
  • Active medical insurance / تأمين طبي
  • Qiwa account for approval / حساب قيــوة للموافقة

Contract Duration / مدة العقد

  • Minimum: 1 month / شهر واحد
  • Maximum: 6 months / ستة أشهر
  • Extension / التمديد → Requires new contract (up to 12 months if allowed)

Nitaqat Check & Calculation احتساب نطاقات

  • During contract creation → System checks Company B’s Nitaqat / نطاقات status
  • If Company B is in “Red Zone / نظاق احمر” → contract rejected
  • Once active → Worker counts toward Company B’s Nitaqat
  • Company A’s Nitaqat unaffected

Fees Structure رسوم العقد

  • Per worker per month / لكل عامل في الشهر
  • Example 160 Per Month.
  • Paid by Company B (Borrower / الشركة المستعيرة)
